TERMS AND CONDITIONS 3D.RU EVENT 2021


1. Terms and Definitions

1.1. 3D.RU Company (Organizer) means "3D.RU Distribution" LLC, having registered office at Kolpakova St. 2/13, rooms 268, 269, Mytischi, Moscow region, Russia, 141002, OGRN (reg. no.) 1135029011886, INN (taxpayer no.) 5029181006, acting in accordance with the laws of the Russian Federation.

1.2. Platform - a website located at: http://event.3d.ru, which is the official web-page of the Event, including all resources, materials, documents and other information posted on it.

1.3. 3D.RU Event (Event) is the activity of the 3D.RU Company on organizing and holding events for the creation, development and implementation of ideas in the form of Concepts for products and services in the field of 3D printing, whereby interaction with the Participants of the Event is expected.

1.4. User – anyone using the Platform.

1.5. Fields - elements of the Platform intended for the User to enter information, both mandatory and optional (mandatory fields are marked with "*").

1.6. Event Participant - an individual who meets the requirements specified in the Terms and Conditions, acting on his/her own behalf alone or as part of a Team, who has submitted an Application for participation in the Event in accordance with the terms of these Terms and Conditions.

1.7. Event Team (Team) - a group of Participants acting on their own behalf and united to jointly submit an Application. Each Participant can be a member of several Teams. The number of Participants in one Team is not limited. The Participant can join Event alone, in which case the Team consists of one Participant who is the Team Representative.

1.8. Event Team Representative (Team Representative) is one of the Team Members of the Team's choice who submits an Application on behalf of the Team. Team Representative is acknowledged at the time of submitting the Application on the Platform. In case of sole participation, Team Representative is considered sole Participant.

1.9. Event Winners (Winners) - Participants (solely or as part of a Team) whose submitted Concepts are chosen by the Jury as the best based on the Jury's decision.

1.10. Event Jury (Jury) - a collegial body consisting of experts, deciding on the Winners of the Event.

1.11. Application for participation in the Event (Application) – Fields of the relevant section of the Platform which are filled in and sent to the Organizer by clicking the "Submit" button.

1.12. Concept – a unique idea related to 3D printing industry, expressed in the form of presentation, video or photo. One Participant / one Team is entitled to submit several Concepts.

1.13. Place of Event - Platform http://event.3d.ru.

1.14. Intellectual Property Rights - All intellectual property rights, including rights to (i) inventions (patents for inventions, rights to obtain patents for inventions, including pending patent applications, reissued patents, repeated applications or applications continuation and partial continuation), utility models; (ii) copyright; (iii) designs and industrial designs; (iv) trademarks, service marks, product design and rights to similar items; (v) trade secrets, other information constituting trade secret and confidential information; (vi) rights to integrated circuit layouts and rights to templates (masks); (vii) other intellectual property rights.

1.15. User Content (Content) - information (including textual, graphic) specified by the Participant in the Application, including summary of the essence of the idea, an indication to which technological direction the idea belongs, an indication of the technologies such idea can be implemented into. The Content does not include Personal Data.

1.16. Personal data - information that relates in any way to a specific or identifiable individual (for example, name, email address, phone number). The Company's treatment of Personal Data is determined in accordance with the Privacy Policy posted on the Platform.


2. General Provisions

2.1. These Terms and Conditions define goals, objectives and procedure for the Event.

2.2. These Terms and Conditions define rights and obligations of the Company and the Participant of the Event, including the procedure for providing information by the User when filling out the Fields of the Platform, the related restrictions, as well as guarantees of the Participant.

2.3. The announcement of the terms of the Event shall be made by posting the relevant information and these Terms and Conditions on the Platform.

2.4. The Organizer reserves the right, at its sole discretion, to cancel, terminate, suspend or extend the Event, as well as change any terms of these Terms and Conditions at any time and for any reason, without incurring any liability before the Participants and any other third parties.

2.5. Event is not a public competition in the meaning of the Article 1057 of the Civil Code of the Russian Federation.


3. Goals

3.1. Event is aimed to find and support the best ideas for solving technological, engineering, economic and other issues in the field of 3D printing, as well as to use of the knowledge and Concepts for the development of 3D printing.

3.2. Purposes of the Event are:

  • provision of the Participants with opportunity to implement their ideas as Concepts in order to determine their relevance and popularization;
  • increasing the awareness of "3D.RU" brand;
  • development of a professional community in the field of 3D printing;
  • analysis of the received ideas and Concepts, and identification of current directions for the development of the 3D printing sphere;
  • determination of the best Concepts and their use as proposals for implementation in the further activities of the Organizer.


4. Terms

4.1. Event will be held from 01 July 2021 to 31 January 2022 in accordance with the following schedule:

- Collection of Applications for participation in the Event: from July 01, 2021 to December 16, 2021;

- Evaluation of submitted Concepts and selection of winners: from December 17, 2021 to January 31, 2022.


5. Collection and Evaluation of Applications

5.1. Сollection of Applications for participation in the Event is carried out through the Platform. Requirements for topics, Applications, Participants and Teams are presented in these Terms and Conditions or on the Platform.

5.2. A Team may submit Application through the Platform via Team Representative. Sole Participants are recognized as Team Representatives and apply on their own behalf.

5.3. By filling out electronic Application form, the Participant gives consent to his/her personal data to be processed by Organizer in accordance with the Privacy Policy.

5.4. When Team Representative submits an Application on behalf of a Team, consent to processing of personal data is acknowledged to be provided by each Member of the Team. Team Representative guarantees that he/she has received the above consent to the processing of personal data from each Team Member. In case of failure to obtain such consent, the Team Representative is responsible for all possible claims of the Participants or third parties (including government authorities).

5.5. Failure to comply with these requirements shall be the basis for refusal to Application registration and provision of the status of a Participant to User.

5.6. Once the Participant submits the Application, all Content becomes available to the Company and can be stored, processed, collected, systematized, translated into other languages, transmitted and discussed both in the Company and publicly in order to implement the Event. The Company is entitled to store and use the Content in order to protect rights and/or legitimate interests of the Company, its affiliates and/or third parties (including in the event of disputes, legal proceedings); for statistical, research or marketing purposes (for example, to check and improve the quality of the Platform, to analyze the effectiveness of the information collection technologies used, to summarize and present information on the total number of ideas submitted by the Participants).

5.7. Intellectual property rights to the Concept and Content remain with the Participant.


6. Procedure for Event

6.1. Participation in the Event is free. The condition for participation in the Event is not the purchase of a specific product.

6.2. The Jury members evaluate the Concepts of the Participants and select the winners of the Event within the time limits established by these Terms and Conditions.

6.3. Event participants shall bear all expenses in connection with participation in the Event.

6.4. Any Concepts in the field of 3D printing are accepted to participate in the Event without limitation.

6.5. Information provided in the Application shall be complete, accurate and reliable and shall not violate third parties’ rights, including intellectual property rights, rights to protect reputation and integrity.

6.6. The fact of participation in the Event implies that the Participants agree that their names, surnames, photographs, interviews, and other materials about them can be used by the Organizer, including posted in media as information related to the Event, should the Participants win.


7. Requirements for Participants

7.1. Participant is an individual of at least 18 years of age as of the date of the Application submission. The number of applications is not limited.

7.2. Violation by the Participants of one or more of the requirements of these Terms and Conditions and/or failure to provide consent to the processing of personal data leads to the immediate cancellation of the Application and termination of participation in the Event.

7.3. The Participant is responsible for the use of the e-mail address specified in the corresponding Field of the Platform, as well as for the content of outgoing mails to the Company's address.

7.4. The Participant guarantees that the Content does not contain Personal Data, and that ideas and other information provided in the Content belong to the Participant. The Participant has all necessary and sufficient rights and/or consents in relation to the Content. The Content and its form of expression do not violate rights and legitimate interests of any third parties. The Participant grants the Company the right to store, process and use the Content in accordance with the terms of these Terms and Conditions. The Participant further guarantees that the provision of ideas and other information to the Company and the use of the latter will not violate rights, including intellectual rights, and/or the legitimate interests of any third parties, including rights of subjects of personal data, and will not create obstacles in exercise of rights by third parties.

7.5. The Participant further guarantees that the Content provided to the Company by submitting an Application, including concepts, principles, methods, systems, ways of solving technical, organizational and other tasks, is not protected intellectual property in accordance with the relevant applicable law.

7.6. The Participant confirms that the decision to take part in the Event is independent and voluntary. The Participant does not have right to demand any compensation for the ideas, information provided in the Application.

7.7. The Participant assumes full personal responsibility and all risks associated with the use of the Platform and the placement of Content.

7.8. The Participant undertakes to comply with the terms of these Terms and Conditions, as well as Privacy Policy.

7.9. By accepting these Terms and Conditions, the Event Participant further confirms and guarantees that:

- the concept is original and is not a copy of the works of third parties, does not violate copyright and (or) related rights of third parties in relation to intellectual property;

- The Сoncept does not violate the applicable laws, does not discredit any person, project or product, and does not otherwise give grounds for legal prosecution as damaging the name, reputation, honor, dignity, activities, project or products of any person, does not contradict public interest.

- The Concept is not encumbered with the property rights of third parties, is not the subject of claims, lawsuits or claims of third parties.

- With regard to the Concept, as well as its elements, no application for registration of Intellectual Property Rights has been submitted and will not be submitted.


8. Evaluation of Concepts

8.1. Criteria used for evaluation of Applications and Concepts:

- immediacy of the problem which can be solved by implementation of the Concept;

- novelty and authenticity of the Concept;

- technical (technological) feasibility of the Concept;

- assessment of the market potential of the Concept.

8.2. Based on the results of the assessment, the Jury forms a list of Winners. The number of Winners can be changed by the decision of the Jury.


9. Event Prize Fund

9.1. Event Prize Fund consists of the opportunity for the Winner to receive financial funding for the Winner's Concept in the manner determined by the Company.

9.2. The Winners of the Event are awarded the right to receive the Event Prize Fund.

9.3. Violation of the rules specified in these Terms and Conditions is the basis for refusal to provide Event prizes without any compensation or reimbursement, including reimbursement of the Participants' expenses.


10. Platform Terms of Use

10.1. The Company does not bear any obligations on the availability and quality of the User's access to the Internet, the availability and quality of the appropriate equipment and necessary software for Internet access. The Company is not responsible for any failures or other problems of any telephone networks or services, computer systems, servers or providers, computer or telephone equipment, software, e-mail failures or scripts (programs) for any reason.

10.2. The Participant agrees that he/she sends the Application via unsecured electronic communication channels of the public computer network, and the Company is not responsible for the safety of information transmitted through such electronic communication channels of the public network, as well as for delays, failures, incorrect or untimely delivery, deletion or non-preservation of any information that constitutes the Participant's Content.

10.3. The Platform and all information, materials, resources of the Platform are provided "as is". The Company does not guarantee that: the Platform meets any requirements and expectations of the User, or is suitable for use for purposes other than those specified in this agreement; the materials, resources of the Platform are accurate, complete or useful; the operation of the Platform will be uninterrupted and / or error-free.

10.4. Except as expressly described in these Terms and Conditions and with the exception of guarantees and conditions that cannot be excluded and limited in accordance with applicable law, the Company does not provide the User with any guarantees, conditions, representations (express or implied on the basis of applicable law, common law, custom or other basis) in relation to the Platform and the terms of its use.


11. Limitation of Liability

11.1. The Company is not liable: for the Participant's Content, including any information, materials, ideas, their description, images, data; for the actions of the Participant to post / provide specified Content, including through the Platform; for any other actions of the Participant related to the use of the Platform, participation in the Event, and not complying with (1) these Terms and Conditions, (2) other rules, policies, instructions, agreements governing the relevant relations on the use of the Platform, participation in the Event, (3) and / or the legislation applicable to such relations. The Participant is personally responsible for all of the above actions and the Content posted / provided by him/her.

11.2. The Company is not liable for any negative consequences caused by the incorrect indication of the email address by the Participant, including for possible disclosure of the Participant's information as a result of such an incorrect indication of the email address, for the Participant's failure to receive the Company's notifications / messages provided for by these Terms and Conditions, etc. The Company is also not responsible for any hacking of passwords, access keys to the Participant's email address by third parties, as well as for any actions of third parties carried out using the Participant's email address.

11.3. The Company shall under no circumstances be liable for the loss of any data or information, forced business interruptions, claims, any damage and other losses (in particular, actual, indirect, special, indirect, punitive), including loss of profits (not received income) related to the use of the Platform, placement through the Platform of any information, including the Content, and its content, possible errors, typographical errors on the Platform and other circumstances due to the Participant's participation in the Event.


12. Final Provisions

12.1. All claims regarding the Event shall be sent to the Company: projects@3d.ru.

12.3. Any communication within the Event shall be undertaken electronically.

12.4. These Terms and Conditions are governed by the laws of the Russian Federation. Any claims or dispute that may arise in connection with these Terms and Conditions will be solved through negotiation and, should negotiation fail, will be finally resolved by the competent court of jurisdiction.
